What’s it all about?
The consultation which took place in Autumn 2022 gave all residents in the Civil Parish of Penzance access to the draft Penzance Neighbourhood Plan and a chance to give their feedback.
The consultation (called the “Regulation 14” or “Pre-submission” consultation) must take place for a minimum of six weeks and is a requirement of the process set out in legislation.
We have also consulted with a prescribed list of other consultees such as Government Agencies (like the Environment Agency, Natural England, and Historic England), Cornwall Council and others likely to have an interest in the Plan. As the “qualifying body”, Penzance Council has overall responsibility for the Plan and consultation process.
A leaflet drop took place in October to inform residents and businesses about the consultation. Local organisations and community groups, and a statutory list of consultees were contacted directly about the consultation.
When did the consultation start and end?
The Regulation 14 Consultation period started on Monday 24th October 2022 and ended on Friday 30th December 2022.
All comments and feedback on the draft Plan needed to be received by Friday 30 December 2022 to be considered.

What happens after this consultation?
Community Link Group will consider all comments
Following the consultation, the Community Link Group (CLG) will consider the comments received and document responses and potential changes to the draft Plan – changes can be made to the draft Plan as a result of this consultation, it is not set in stone!
Other changes might be necessary as a result of a Strategic Environmental Assessment and Habitats Regulation Appropriate Assessment which are also being carried out on the Plan. These assessments test the Plan’s policies against a series of environmental and sustainability criteria and are a required part of the Plan making process. Once these assessments have been completed they will be made available on Our Evidence Base page.
Approval by Penzance Council
When changes have been made by the Community Link Group in response to public comments and the external assessments, the draft Plan and associated documents will need to be formally approved by Penzance Council before it can be submitted to Cornwall Council.
Submission to Cornwall Council
The final draft of the Plan will be submitted to Cornwall Council who will run a further public consultation (required by law) and arrange for an independent Examination (carried out by an independent Examiner) which tests the Plan against the Governments rules for Neighbourhood Plans, called the “Basic Conditions”. After the independent Examination, there are likely to be further changes to the draft Plan to make sure it meets these conditions.
Referendum
The final version of the Plan will proceed to a local Referendum, run by Cornwall Council, where those living in the civil Parish of Penzance who are registered on Cornwall Council’s Electoral Register will have the opportunity to vote to decide whether or not the Plan should be brought “into force” so that Cornwall Council can “make” (adopt) the Plan as a statutory Plan.
If the Plan is adopted, Cornwall Council will use the Plan in determining planning applications alongside the Local Plan and other Cornwall Council planning policies and guidance.
